1. Organiser and scope of services
Skanda Surf services are provided by BI Consulting sp. z o.o., with its registered office at ul. Trylińskiego 2, Olsztyn, Poland, tax identification number (NIP): 7393979101, referred to below as the “Organiser”.
These terms apply to eFoil Start, Progress and Ride sessions and to eFoil Weekend rental. The detailed scope, duration and price of each service are confirmed before it begins.
2. Conditions of participation
A participant must be able to swim, feel comfortable in deep water, be able to reach the board or shore independently, and have no known medical contraindications to physical activity on the water.
eFoil use is available to people aged 16 or over. A participant aged 16–17 may take part only with the consent and in the presence of a parent or legal guardian, who signs the required documents. The Organiser may refuse to begin or may stop a session if the participant’s ability, behaviour or condition, or the conditions on the water, raise reasonable safety concerns.
eFoil Weekend rental is available only to adults whose skills have previously been verified.
3. Briefing and on-water support
Before a session, the participant receives a safety and equipment briefing. During Start or Progress, the Organiser provides the agreed technical support on the water. This is not a rescue service and does not mean that every fall, collision or participant error can be physically prevented.
The participant must follow the instructor’s directions, wear a helmet and buoyancy aid, maintain a safe distance from people and obstacles, and immediately release the trigger when losing balance. Use of the equipment under the influence of alcohol, drugs or substances that impair ability is prohibited.
4. Awareness of risk
eFoiling is a higher-risk activity. The participant acknowledges the possibility of falling into the water, losing balance, collision, hypothermia and contact with the board, mast, wings or propulsion. Foil and propulsion components can cause serious injury.
The briefing, protective equipment and support reduce risk but cannot remove it entirely. Participation is voluntary, and the participant is responsible for following the rules provided and acting within their ability.
5. Equipment handover and documentation
For eFoil Ride and eFoil Weekend, the condition and completeness of the setup may be documented in photographs or video taken by phone and sent in the WhatsApp or SMS/MMS conversation relating to the booking. The material may show the equipment and visible identifying marks without recording the customer’s image.
The person collecting the equipment should report any visible concerns before use begins. Weekend rental additionally requires a contract, the agreed deposit and confirmation that the setup is complete.
6. Responsibility for equipment
The participant may use the equipment only within the agreed scope and may not allow another person to use it without the Organiser’s consent. The participant is responsible for documented damage caused by intentional action, gross negligence, violation of instructions or use contrary to the equipment’s purpose. This does not include normal wear resulting from proper use.
The deposit secures potential claims. It is not an automatic penalty and does not limit liability to the deposit amount. The rental contract sets out the settlement rules.
7. Weather and ending a session
The Organiser may reschedule, limit or stop a session because of weather, water conditions, equipment failure, or the safety of the participant or other people. The participant must stop using the equipment immediately when instructed to do so.
8. Participant declaration
Before entering the water, the participant signs a declaration confirming swimming ability, absence of known contraindications, completion of the briefing, awareness of risk and receipt of protective equipment. For a minor, the document is also signed by a parent or legal guardian.
9. Final provisions
Neither these terms nor the participant declaration exclude the Organiser’s liability to the extent that such exclusion is not permitted by law.
Any disputes will be resolved by the court having jurisdiction under applicable law. The processing of personal data, including material documenting the equipment, is described in the Privacy policy.
